U.S. Supreme Court denies Virginia stay request

(The Center Square) – The U.S. Supreme Court on Friday denied an emergency request from Virginia Democrats and state leaders seeking to pause the Virginia Supreme Court’s ruling that voided the commonwealth’s congressional redistricting referendum.

The order stated: “Application (25A1240) for stay presented to The Chief Justice and by him referred to the Court is denied.”

The emergency application had been filed by House Speaker Don Scott, D-Portsmouth; Senate Majority Leader Scott Surovell, D-Fairfax; Senate President Pro Tempore Louise Lucas, D-Portsmouth, and the Commonwealth of Virginia in Scott v. McDougle.

The Virginia Supreme Court ruled May 8 that the General Assembly missed a constitutional deadline because lawmakers approved the amendment after early voting had already begun for the November 2025 House of Delegates elections.

In a statement Friday, Senate Republican Leader Ryan McDougle said, “The Supreme Court of the United States has affirmed what we always knew: you cannot violate the Constitution to change the Constitution.”
