Court Rules Noem Illegally Rolled Back TPS for Venezuelans and Haitians

(AURN News) — The U.S. Court of Appeals for the Ninth Circuit ruled that the Trump administration illegally stripped Temporary Protected Status from Venezuelans and Haitians.

In its decision, the court said Homeland Security Secretary Kristi Noem overstepped her legal authority when she attempted to undo or vacate a Biden-era TPS extension for Venezuela, terminate Venezuela’s TPS early and shorten Haiti’s TPS period midstream.

Judges said federal law does not allow DHS to rewrite or erase TPS protections once they have been lawfully granted.

The court affirmed the lower court’s ruling and set aside those actions under the Administrative Procedure Act, the federal law governing how agencies make and change policy, calling the administration’s moves unlawful.

As a result, hundreds of thousands of Venezuelan and Haitian immigrants remain protected, allowed to work, stay with their families and avoid deportation.
