A federal judge in New Hampshire has ruled against President Donald Trump’s executive order ending birthright citizenship, calling it “lawless, unconstitutional and cruel,” according to the Associated Press.
The judge announced he will certify a class-action lawsuit on behalf of all affected children and issue a preliminary injunction temporarily blocking the order.
The case centers on the 14th Amendment, which guarantees citizenship to all people born in the U.S.
The plaintiffs, represented by the ACLU, include a pregnant asylum-seeker from Honduras and a Brazilian father of a newborn. The judge said depriving children of U.S. citizenship amounts to irreparable harm.
Multiple federal judges have blocked the order, and new class-action challenges are unfolding nationwide.
