Court Clears Way for National Guard Deployment in Portland

(AURN News) — A federal appeals court has cleared the way for President Donald Trump to deploy the Oregon National Guard to Portland, overturning a lower court’s ruling and finding the move a lawful use of presidential power.

Oregon’s Democratic leaders called the decision an abuse of power that undermines state sovereignty and First Amendment rights.

The Trump administration is also pushing to send troops to Chicago and San Francisco — moves that many officials are calling unconstitutional.

“I am deeply grateful to the members of our military for their service to our country, but the National Guard does not have the authority to arrest drug dealers. Sending them to San Francisco will do nothing to get fentanyl off the streets, nor will it make our city safer,” said San Francisco Mayor Daniel Lurie in a statement Monday.

Oregon Attorney General Dan Rayfield is asking the 9th U.S. Circuit Court of Appeals for an emergency rehearing.
