Court Strikes Down Trump’s Birthright Citizenship Ban as Unconstitutional

A federal appeals court ruled that President Donald Trump’s executive order to end birthright citizenship violates the 14th Amendment.

In a 2-1 decision, the Ninth Circuit Court of Appeals said the president cannot strip automatic U.S. citizenship from children born on American soil to undocumented immigrants or foreign visitors. That’s been the law since 1868, and the court made that clear.

The case was brought by a coalition of Democratic-led states, who argued the policy would upend vital systems like education, health care and identification across state lines.

The court agreed and upheld a nationwide block to keep Trump’s order from taking effect. The decision comes just weeks after the Supreme Court ruled to limit the scope of federal injunctions.

It stopped short of endorsing Trump’s policy. The appeals court said this is one of those rare cases where a nationwide halt is necessary because rights this fundamental shouldn’t depend on what state you’re born in.
