Former Pembroke mayor’s petition dismissed by state Supreme Court

(Carolina Journal) – Former Pembroke Mayor Charles Gregory Cummings’ petition in the legal battle over the town’s 2023 mayoral election has been dismissed by the North Carolina Supreme Court.

Justices issued an order Thursday without comment. It dismissed Cummings’ request for an order that would have blocked lower court rulings against him.

The state Supreme Court’s latest order arrived nearly two months after the high court denied a temporary stay that would have blocked state elections officials from certifying Allen Dial as winner of the disputed election.

Dial was sworn into office in March, more than two years after the election. His term in offices runs through 2027.

Cummings had remained in office while challenging results of the 2023 election.

The state elections board urged the state’s highest court in March not to step into the legal dispute. Cummings had petitioned the state Supreme Court to block a unanimous March 4 ruling from the North Carolina Court of Appeals.

Cummings is a Republican. Dial is a Democrat.
