Search for conflict prosecutor begins in Trump election interference case

(The Center Square) – The Prosecuting Attorneys’ Council of Georgia is starting its search for a conflict prosecutor in the election interference case against President Donald Trump and others, according to a statement from its executive director.

The Supreme Court of Georgia said Tuesday it would not consider an appeal from Fulton County District Attorney Fani Willis. She was disqualified from the case because of her romantic relationship with the lead prosecutor.

Willis’ office filed charges against Trump and others in 2023, accusing them of trying to interfere in the 2020 presidential election.

A Fulton County judge disqualified Willis and the Georgia Court of Appeals upheld the ruling.

Justice Andrew Pinson, writing for the 4-3 majority, said the issue is unlikely to arise again in future cases.

“Thus, even if one believes that the Court of Appeals erred in reaching that decision, granting review to answer that question would be mere error correction, and this Court generally does not exercise our certiorari jurisdiction merely to correct errors that do not have some broader impact on Georgia law,” Pinson wrote.

Willis said she did not plan to review the appeal.

Peter Skandalakis, executive director of the Prosecuting Attorneys’ Council, said Tuesday afternoon, he realized the case would ultimately land at his office.

“PAC will fulfill its duty under O.C.G.A. § 15-8-5(a) to appoint another prosecutor to take over the cases,” Skandalakis said in a statement. “When that decision is made, it will be announced at the appropriate time. Until then, any action on PAC’s part is premature, and we have no further comments, pursuant to Georgia Rule of Professionalism 3.8 Special Responsibilities of a Prosecutor.”

Trump called the decision a “big win” on social media.

“Just like the purely political, lawless, and dismissed witch hunts brought through the Biden White House by deranged Jack Smith, and others, this unconstitutional Georgia hoax, together with the remaining shams in New York, should now be dead for good,” Trump said.
