Grand jury indicts Brown on federal charge; death penalty possible

(The Center Square) – Decarlos Brown, the suspect charged with first-degree murder of Iryna Zarutska in Charlotte, has been indicted by a grand jury.

The formal accusation means there’s enough evidence for criminal charges of violence against a railroad carrier and mass transportation system resulting in death. Zarutska was aboard a light rail train in North Carolina’s largest city on Aug. 22 when she died.

Video evidence released by Charlotte-Mecklenburg Police and a signed affadavit with still shots from the video shows Brown, 34, stabbing her to death.

The indictment says Brown is eligible for the death penalty in conjunction with a 2015 conviction for armed robbery. If convicted, he could face life in prison if not death.

Brown, arrested 14 times over with one significant stint in jail since 2010, was ordered to undergo a competency evaluation while jailed.
