Appeals court pauses Trump’s case to review if DA can stay on

The Court of Appeals of the State of Georgia paused the election interference case against Donald Trump until it can review a lower court’s ruling that allowed Fulton County District Attorney Fani Willis to stay on the case.

The Georgia appeals court agreed to take the case in May. Trump’s defense team had argued that Willis should be removed from their case because of a romantic relationship between Willis and lead prosecutor Nathan Wade. Judge Scott McAfee had said Willis could remain on the case if Wade was removed. Wade then resigned.

The Associated Press reported that the oral argument is tentatively scheduled for Oct. 4 and the appeals court would have until mid-March 2025 to make a ruling.

“The Georgia Court of Appeals has properly stayed all proceedings against President Trump in the trial court pending its decision on our interlocutory appeal which argues the case should be dismissed and Fulton County DA Willis should be disqualified for her misconduct,” Trump’s attorney, Steve Sadow, posted on X.

A Fulton County grand jury indicted Trump and 18 on charges he tried to overturn the results of the 2020 presidential election. Trump pleaded not guilty.
